Description

Submitted May 18, 1951. 1. Counties — Transfer of official duties. Contract between a private individual and board of county commissioners whereby individual agreed to abstract, send out and post notices and to take out tax deeds to all property designated by board was unenforceable, since board had no authority to enter into a contract to place performance of issuing proper notices and tax deeds upon anyone other than county clerk or county treasurer. 2. Contracts — Consideration unlawful in part, effect of. If a part of a single consideration for one or more objects or several considerations for a single object is unlawful, entire contract is void. 3. Pleading — Motion to strike properly used. While a motion to strike cannot take the place of a demurrer to test sufficiency of a pleading capable of being cured by amendments, it is properly used as against a complaint which shows on its face that it cannot be amended to state a cause of action.
